			<title>Court Permanently Enjoins PTO from Enforcing New Rules</title>
			<description> In a much-awaited decision, the United States District Court for the Eastern District of Virginia ruled in Tafas v. Dudas that the new patent rules promulgated by the U.S. Patent and Trademark Office (USPTO) are unlawful, and permanently enjoined the USPTO from enforcing them.  Last year, the USPTO enacted a new set of rules that would have dramatically changed the way patents are prosecuted in the United States. The new rules limited applicants to two continuation applications and one request for continued examination, or RCE (the 2+1 Rule) and limited the number of claims permitted in each application to 5 independent claims and 25 dependent claims (the 5/25 Rule) unless the applicant submitted a comprehensive patentability analysis called an Examination Support Document (ESD). 			<title>Virginia Supreme Court Rules Against Spammer</title>
			<description>In February, the Supreme Court of Virginia upheld by a 4-3 vote the conviction of Jeremy Jaynes for violating the anti-spam provision of the Virginia Computer Crimes Act, (VCCA), Va. Code Ann. &#167; 18.2-152.3:1 (2004). The court&#8217;s decision, Jaynes v. Commonwealth, 275 Va. 341, 657 S.E.2d 478 (2008), affirmed the first felony conviction in the United States for illegal spamming, or the bulk distribution of unsolicited e-mail.  Jaynes, a resident of Raleigh, North Carolina, was considered one of the top 10 spammers in the world before being convicted in 2004 in the Circuit Court of Loudon County, Virginia, and sentenced to nine years in prison. From July 16 to July 19, 2003, he sent to AOL subscribers 55,473 e-mails with falsified header information and sender domain names. 			<description>The United States District Court for the Eastern District of Virginia provides a unique and advantageous forum for bringing an intellectual property case. Unlike most courts throughout the country that take several years to bring a case to trial, in the Eastern District a trial usually is scheduled to start approximately eight months from the filing of the Complaint. The court almost never continues the trial date. Even in complex commercial cases involving difficult intellectual property issues, the court insists that all discovery be completed in a three to five month window.  Because of its speed, attorneys and judges refer to the Eastern District as the Rocket Docket. The Rocket Docket provides two very substantial advantages to an intellectual property plaintiff. 			<title>Secretaries Announce Release of Third &amp;quot;Productivity Investment Fund&amp;quot; RFI</title>
			<description>RICHMOND - Secretaries Viola Baskerville, Aneesh Chopra, and Jody Wagner today announced the release of the third Request for Information (&#8220;RFI&#8221;) calling on state agencies, private sector firms, academic leaders, and citizens to bring forward proposals that could be eligible for the third round of awards from the Productivity Investment Fund. Recipients of the funding will be limited to state agencies, but public-private partnerships are encouraged.
&lt;p&gt;&#8220;We have started to see good results from the first and second rounds of the Productivity Fund and are excited to continue and expand that success going forward,&#8221; said Secretary Chopra. &#8220;The Governor remains committed to improving productivity in government operations and this fund is one of the key vehicles for achieving that goal.&#8221;&lt;/p&gt;
&lt;p&gt;The Fund provides seed money to state agencies to lower operating costs, reduce constituent service transaction times, and advance key performance goals as published on the Virginia Performs website (&lt;a href=&quot;file://www.vaperforms.virginia.gov/&quot;&gt;www.VAperforms.virginia.gov&lt;/a&gt;). 			<description>All is not quiet on the SBIR front, and the focus has now shifted from the House of Representatives to the Senate. Many insiders believe the Senate will give the SBIR reauthorization more balanced consideration.     I had a few people suggest that I was a little too severe in my comments about the H.R. 5819 vote in the House. Perhaps that criticism is correct, and I was too short sighted to realize that the House found it too confusing and time consuming to listen to more than one side of an issue.     The process of the Houses SBIR Reauthorization was every bit the three ring circus described in our last Insider, and was nothing short of an outrage. 			<title>Virginia Clean Cities Bi-Monthly Status Report</title>
			<description>2008 Project Rundown  Virginia Clean Cities and the Hampton Roads Coalition are managing a half dozen alternative fuel projects for the Virginia Department of Mines, Minerals and Energy (DMME) and the US Environmental Protection Agency (EPA) in 2008 thanks to the many stakeholders who partnered to develop these projects or helped to secure grant money to implement them.    Summary of Major 2008 Projects that May be of Interest:  Fleet Conversion: We are looking for government or private fleets that want to make the conversion away from imported fossil fuels toward greater use of cleaner domestic alternatives like biodiesel, electricity, ethanol, hydrogen, natural gas and propane. The idea is to calculate the air quality benefits that would result from a given fleet&#8217;s conversion to cleaner fuels and, to a limited extent, greater focus on transportation energy conservation. Then take the conversion proposals shopping for political, financial and technical support to make them happen. ...

The purpose of this event is to have the nanotechnology community converge in force upon Richmond to illustrate the breadth of the ongoing research and commercial activity in Virginia and to help educate the General Assembly as to what nanotechnology is and why it is important to the Commonwealth. It is critical that research and commercial activities be broadly represented. This is your opportunity to show our legislators what nanotechnology means to Virginia.
